The Supreme Court has rejected the plea of Nnamdi Kanu, the leader of the Indigenous People of Biafra, IPOB, seeking his immediate release from detention.
The ruling followed an appeal by the Federal Government against the October 2022 ruling by the Court of Appeal that voided the terrorism charges against Kanu and ordered his advice.
In a judgment, which was written by Justice Garba Lawal, but delivered by Justice Emmanuel Agim, the apex court acknowledged that the Federal Government was “reckless and unlawful” in the rendition of Kanu from Kenya, but held that it was not enough to strip any court of its power to proceed with the trial.
He added that the only option for Kanu against his unlawful rendition was to file a separate civil action against the perpetrators instead of attempting to stop his criminal trial.
