Ibezim vs Araraume: Confusion as High Court overrules Supreme Court

Confusion has enveloped Nigeria’s judiciary following the upturning of an earlier judgment by the Supreme Court.

The Supreme Court had, in an earlier judgement, affirmed that Sir Frank Ibezim was the authentic candidate of the All Progressives Congress (APC) in the December 5, 2020, by-election for Imo North Senatorial District of Imo State.

However, Justice Taiwo Taiwo of the Federal High Court, in Abuja, on Thursday, overruled the apex court judgment and ordered the Independent National Electoral Commission (INEC) to issue Senator ifeanyi Ararume Certificate of Return as winner of the by-election.

Ibezim and Araraume have been contending who was actually the APC candidate in the by-election, an issue the Supreme Court had since resolved in Ibezim’s favour before the confusing judgment.

Expectedly, Ibezim has quickly appealed against the judgment and also filed for Order of Stay of Execution at the Appeal Court.
