Dandi/Arewa Fed. Const.: Appeal Court dismisses Hussaini Kangiwa’s suit

The Court of Appeal, Sokoto Division has dismissed a suit filed by former Lawmaker, Hussaini Kangiwa, challenging the declaration of  Alhaji Umar Kamba of the APC  as the right candidate for the Dandi/Arewa Federal Constituency.

Kangiwa urged  the court to upturn a  judgment of  the Federal Hight Court Birinin Kebbi which declared Kamba as right candidate.

Delivering judgment on Friday, Justice Ahmed Belgore, held that the court considered all the grounds of appeal, parties positions and submissions.

He held that the lower Court was right to uphold Kamba as the winner of  the primary election conducted by the APC which produced him as candidate.

The judge held that Kangiwa had no ‘ locus standi” within the ambit of the constitution to institute the matter.

Justice Belgore held that Kangiwa’s substitution after the primary election which produced Kamba has not been substantiated as raised in the respondent’s testimonies at the lower Court.

In a related development, Justice Belgore, delivered another judgment prepared by his colleague, Justice Fedric Oho, on the sister appeal suit filed by the APC challenging the same judgment delivered by Birnin Kebbi Federal High Court in favour of Kamba on April 17, 2019.

He held that court also considered all grounds of appeal and arrived that the APC appeal lacked merit and dismissed same.

Belgore held that the APC’s arguments on two election panels could not hold water as Independent National Electoral Commission (INEC) another respondent in the suit had supervised the primary election and result declaration was made.
