BREAKING: Appeal Court affirms Ifeanyi Ubah’s election as senator

Senator Ifeanyi Ubah of the Young Progressive Party was on Thursday affirmed as duly elected senator, representing Anambra South Senatorial Zone.

Ubah’s election was on January 17, 2020, nullified by Justice Bello Kawu of the Federal Capital Territory (FCT) High Court in Kubwa, Abuja, who ordered the Independent National Electoral Commission,  INEC, to retrieve the Certificate of Return issued to Ubah, as senator, representing Anambra South. 

It also ordered a fresh certificate should be issued to the candidate of the Peoples Democratic Party, PDP, Obinna Uzoh, who came second in the election, as the senator-elect of the district instead of Ubah.

However, Ubah appealed the judgment, insisting that was a grave miscarriage of justice against him. The three man-panel of the appellate court  led by Justice Stephen Adah in an unanimous decision held on Thursday that the lower court had no jurisdiction to have entertained the matter hence its decision on the matter thanks and void. 

In the lead judgment,  Justice Adah held that “the appeal of the appellant has merit and it is hereby allowed.”

The appellate court further ordered the first and fourth respondents to pay Ubah N250,000 each.
