Appeal Court nullifies election of APC senator-elect

The Court of Appeal, sitting in Abuja, has nullified the election of Mohammed Sani Musa who was declared the winner of the Niger East Senatorial District election on the platform of the All  Progressives Congress (APC).

The appellate court, in a judgment read by Justice Stephen Adah, declared Sen. David Umaru, as the senator-elect for the senatorial district.

Justice Adah arrived at the decision after setting aside the judgment of a Federal High Court in Abuja on the grounds that the court lacked the jurisdiction to entertain the matter having become statute barred by law.

The judge directed the Independent National Electoral Commission (INEC) to issue Sen. Umaru with a certificate of return.

The court ruled that Umaru was the duly elected candidate of the APC. Reacting to the judgment, Sen. Umaru said the judgment had vindicated him.

He expressed appreciation to God and his supporters who stood by him.

However, the legal team representing Sani Musa expressed the intention to appeal to the Supreme Court following the decision of the Court of Appeal.
